1. Acceptance of Terms

By creating an account or using GameFold, you agree to these Terms of Service and our Privacy Policy. If you do not agree, you must not use the app.

You must be at least 13 years old to use GameFold. By registering, you confirm that you meet this age requirement.

2. Description of Service

GameFold is a mobile application that allows users to:

• Discover, track, and organize video games
• Rate and review games
• Create and share curated game lists
• Follow other users and explore gaming content
• Receive personalized recommendations

Game data is provided via third-party APIs (e.g., RAWG) and may not always be complete or up to date.

3. User Accounts

You are responsible for:

• Maintaining the confidentiality of your account credentials
• All activity that occurs under your account
• Providing accurate registration information

You must not:

• Create accounts for others without their consent
• Use another person's account without permission
• Create multiple accounts to circumvent bans or restrictions

4. User Content

You retain ownership of the content you create (reviews, lists, ratings). By posting content on GameFold, you grant us a non-exclusive, worldwide, royalty-free license to display, distribute, and promote your content within the app and associated marketing materials.

You are solely responsible for the content you post. Content must not:

• Violate any applicable laws
• Infringe third-party intellectual property rights
• Contain spam, malware, or deceptive material

5. Content Moderation

We reserve the right to review, edit, or remove any content that violates these Terms or that we deem inappropriate, including but not limited to:

• Hate speech, harassment, or threats
• Sexually explicit content not marked appropriately
• Spam, advertising, or self-promotion
• Impersonation of others
• Content that promotes illegal activities

Users may report content or accounts through the app using the "Report" option on any review, list, or profile. We aim to review reports within 48 hours, and may temporarily or permanently hide content, suspend accounts, or take other appropriate action while we investigate.

6. Acceptable Use

You agree not to:

• Post abusive, defamatory, or illegal content
• Attempt to exploit, hack, or reverse-engineer the app
• Scrape, crawl, or use automated access on GameFold data
• Interfere with the app's operation or other users' experience
• Use the service for commercial purposes without written permission
• Attempt to circumvent security measures or rate limits

We reserve the right to suspend or terminate accounts that violate these rules.

7. Intellectual Property

The GameFold name, logo, and branding are our intellectual property. You may not use them without prior written consent.

Game data, images, and metadata are provided via third-party APIs and remain the property of their respective owners.

Open-source components used in GameFold are subject to their respective licenses.

8. Third-Party Services

GameFold integrates with third-party services including RAWG API, Supabase, PostHog, and Sentry. We are not responsible for the availability, accuracy, or content provided by these services. Their respective terms and privacy policies apply to their services.

9. Service Availability

GameFold is provided "as is" and "as available". We do not guarantee uninterrupted or error-free service. We may:

• Perform maintenance that temporarily affects availability
• Modify, suspend, or discontinue features with reasonable notice
• Limit access in certain regions due to legal requirements

10. Limitation of Liability

To the maximum extent permitted by law, GameFold and its operators shall not be liable for:

• Indirect, incidental, or consequential damages
• Loss of data beyond what is stored in our systems
• Service interruptions or downtime
• Actions of third-party services
• User-generated content posted by other users

Nothing in these Terms excludes liability for fraud, gross negligence, or any liability that cannot be excluded under applicable law.

11. Account Termination

By you: You may delete your account at any time from Settings, or follow the instructions on our account deletion page. Account deletion is permanent and irreversible — all data including reviews, lists, and profile information will be permanently removed.

By us: We may suspend or terminate accounts that:

• Violate these Terms of Service
• Engage in abusive or fraudulent behavior
• Remain inactive for an extended period (with prior notice)

We will make reasonable efforts to notify you before or at the time of suspension, except in cases of severe violations.

12. Governing Law & Disputes

These Terms are governed by the laws of Spain.

Any dispute arising from these Terms or the use of GameFold shall be submitted to the courts of the city where the data controller is domiciled, unless applicable consumer protection law provides otherwise.

EU consumers retain the right to bring claims in their country of residence. You may also use the European Online Dispute Resolution platform for alternative resolution.

13. Changes to Terms

We may update these Terms of Service from time to time. When we make material changes:

• We will update the "Last updated" date
• We will notify you in the app
• If changes are significant, we may require re-acceptance

Continued use of GameFold after changes constitutes acceptance. If you do not agree to updated Terms, you must stop using the app and may delete your account.
